I finally found the reason why the game is laggy and has bad graphics when using win8 and an ATI card. The problem is driver related.
I think the game starts in softwareaccellerated mode if there are no opengl drivers. So to fix this:
  • Go to device manager
  • Go to the Display adapters
  • If there is a bracket with(WDDM 1.x) behind the graphics card, this fix will work
  • http://support.amd.com/en-us/download  go to that site
  • Search for the video-drivers for your card
  • download the installer
  • run the installer until you see a welcome screen
  • cancel now, dont continue with the setup
  • go to the Folder where the drivers got extracted
  • in my case it was C:\AMD\
  • continue with going to C:\AMD\Support\xx-x-legacy_vista_win7_64_dd_ccc\Packages\Drivers\Display\W76A_INF
  • in the W76A_INF folder should be some files like ch... and c7...
  • Dont run anything in here.
  • copy the path of that W76A_INF folder by clicking in the top-bar of the explorer (CTRL+C)
  • go back to the device manager and rightclick you graphicscard
  • select update drivers(1st option)
  • select "search on harddrive for driversoftware(2nd option)
  • select "choose of a list of drivers...(below the field were you can type in a path)
  • select harddrive (above cancel)
  • paste the path(CTRL+V)
  • there should be at least 1 new driver in the list
  • select new one(the one that is named like your card, not wddm and not basic adapter)
  • click on continue(the screen should go black a few times)
  • Exit the menus
  • check the device manager and see if the wddm behind you card is gone
  • start hammerwatch, enjoy the awesome game

This fixes the game, at least it did for me, it also fixed other opengl using games like minecraft
